GENERAL CONDITIONS OF SALE OF THE COMPANY UNNIQ HABITAT, S.L :
The company UNNIQ HABITAT, S.L., which sells furniture in Spain. With the aim of fulfilling its customers’ expectations more effectively, UNNIQ HABITAT, S.L. has created the online sales platform for its products, www.unniq.co.uk/. These General Conditions of Sale (hereinafter, the "GCS ") regulate the contractual relations between UNNIQ HABITAT, S.L. and its consumers for each online sale made through the electronic commerce platform www.unniq.co.uk entre:
The company UNNIQ HABITAT, S.L. has its registered address at Carrer de Calàbria, 149, entresòl, 1ª, 08015 Barcelona, Spain, with telephone number +34 682 634 027 and email address [email protected], and its customers, hereinafter "the customer" or "the customers".

Article 1. SCOPE OF APPLICATION

Any transaction made through website is subject to the General Contracting Conditions applicable on the date of the order. The General Terms and Conditions are subject to change without prior notification. The automatically apply to any sale made subsequently on the website. In the event that any of the clauses of the General Contracting Conditions is deemed null and void or cancelled, all other clauses will remain in force. The fact that seller may not apply an Article of these conditions at any given time does not imply the waiver of their right to apply the aforementioned General Conditions of Sale at a later date. It is hereby declared that the seller does not promote their products by cold calling or door-to-door sales and, as such, the provisions of the Consumer Code that apply to these sales techniques for not apply to the relations between the customer and the seller.

Article 2. ORDERING

All the steps required to make a purchase are specified on the website www.unniq.co.uk. Any order placed online implies full awareness and acceptance of these terms and conditions, as well as the possession of a valid email address, from the time the order is placed to the date of the invoice being issued. The customer is liable for any telecommunication expenses that may be incurred when they access the Internet and use the website www.unniq.co.uk. The seller has the right to refuse any abnormal order or any order made in bad faith. Moreover, the seller has the right to reject any order from a customer with whom there has been a dispute regarding the payment of a previous order.

Article 3. PRODUCTS - SUPPLY

The seller will make already reasonable efforts to provide photographs, images and descriptions of the products that are as representative and faithful as possible. However, they are only provided for information purposes and the seller cannot be held liable for them. Customers can obtain additional information by contacting the Customer Service Department, sending an email to [email protected]. The sale of goods offered through the presentation of the products and prices indicated are valid within the limitations of the available stock. The suppliers of UNNIQ HABITAT, S.L. reserve the right to modify the product during the collection and, as a result, UNNIQ HABITAT, S.L. may have to deliver a similar article to the customers, at the same price and of the same quality as the product presented on the website. In this case, if the customer is not satisfied with the product supplied, they may proceed with the returns procedure specified in Article 10, which stipulates the customers’ right to change or return the product.

Article 4. PRICES

From the 1st of January 2021, because of the BREXIT, European rules no longer apply in the UK. The prices appear exclusive of tax. The goods are shipped from Spain, so it is an export for UNNIQ HABITAT, and an import for the british customer. The prices are indicated in Pound sterling and are only applicable for sales concluded from the site www.unniq.co.uk. The buyer will receive an invoice with the information on the purchase of the product(s) he has acquired, with the order number, the price excluding tax, the seller's tax data and the buyer's data. UNNIQ HABITAT, S.L. will pay the customs fees corresponding to the order, but the customer will have to bear the payment of the british local tax and the payment of import taxes. When placing the order, the customer's identity card number will be requested, the customs agency will need it to let the goods pass.

You'll  also need an EORI number to clear your goods through UK Customs. EORI is the acronym for an Economic Operator Registration and Identification number. To apply for an EORI number, all you need to do is fill in an online form that’s submitted to HMRC using your Government Gateway account (the same one you’ll use to submit your tax returns, the application form is available here, and it's totally free.

Article 5. PAYMENT

UNNIQ HABITAT offers several means of payment: bank card, bank transfer, or by Paypal. You can view the page https://www.unniq.co.uk/payment-methods for more information.
Payment is to be made in full when placing the order by credit card (Mastercard, Visa), without any discount. UNNIQ HABITAT, S.L. has chosen to use the TPV Virtual online platform provided by Santander, as it is based on Verified by Visa/Mastercard Secure Code, the two global programmes selected by all Spanish and international banks to protect against fraudulent credit card use.

  1. You make your purchases at our online store and choose the credit card payment option. You identify yourself as the cardholder by entering the card number and security code (on the back of the card).
  2. Encryption of your bank details: all the bank details entered are encrypted by our bank’s server.
  3. After validating your bank details, a 3D-Secure window managed by your bank will appear.
  4. The secure system verifies that authentication has been completed before the usual checks for completing the transaction are carried out and it is ensured that your payment card has not been used by any criminal organization.
  5. None of the information entered is transmitted through or website or servers. The transaction is validated by our bank and redirected to our website.

You can pay by PayPal. It is secure, simple and free of charge. PayPal is a service that lets you pay online, send and receive money without sharing your bank details. As a European Union banking institution, PayPal boasts more than 10 years’ experience insecure online payments. PayPal encrypts and ensures your bank details and never passes them on to the recipient of your payments. It is fast and easy. You will no longer have to enter the 16 digits of your credit card every time you shop online. Simply use your PayPal account, with your email and password. Your transactions are instantaneous. The service is free of charge. Shopping online with PayPal is no more expensive than using your credit card. If your shop in euros within the Eurozone, it is completely free of charge.

You can also pay by Bank transfer. At the last step of placing the order, you will need to select the desired option, then you will receive an email with a summary of your order, where the bank details necessary to make the transfer will be indicated.

Article 6. DELIVERY

Delivery of the goods will only be made after the payment of the full order amount has been accepted.

The goods are delivered to the address indicated by the customer when placing the order, which may be different from the billing address. Delivery to the ground floor is included in the price of the products, provided that the delivery address is accessible by the transport agency's truck. A delivery note is attached to the package. The delivery period is between 35 and 40 days from the date of the order. Any delay in the delivery due to circumstances beyond the control of UNNIQ HABITAT, S.L. shall not imply the cancellation of the order, and UNNIQ HABITAT, S.L. cannot be held liable for any damages caused as a result of tis delay. In the event of any delay in delivery due to force majeure, as specified below in Article 12, the seller may choose to cancel the sale or extend the delivery or availability periods, without either of the parties being entitled to claim any compensation.
The delay in delivery can be caused because of a delay in receiving raw material (s), because of the consequences of health restrictions (COVID-19), or because of the consequences to entering too many orders.
Each year, Unniq closes its service in August due to annual leave, so deliveries cannot be made during this period.
In all cases, delivery within the established period will only be made if the customer has fulfilled all their obligations with UNNIQ HABITAT, S.L..

Article 7. MODE OF TRANSPORT

The mode of transport chosen by the seller is contractually considered the best suited for the delivery of the goods shipped. Any disagreement by the customer on this point must be the subject of an express request on their part. Acceptance of this request is at the discretion of the seller. Unless otherwise stipulated, transport operations are the responsibility and at the risk of the seller. By default, the seller offers free delivery to the ground floor of the customer's house, or to the ground floor of the building in the case of an apartment. If the customer wishes for their furniture to be delivered to a specific room in their accommodation, they must consult UNNIQ HABITAT, S.L., who will provide them with the corresponding price for this service. If the customer wishes for the courier to deliver their piece of furniture to a specific room or floor, and for it to be assembled by an expert, they must consult UNNIQ HABITAT, S.L., who will provide them with the corresponding price for this service.

Article 8. RECEIPT - INSPECTION

On the day of delivery, the customer must check the condition of the packages and their number with the carrier, and indicate if there are any missing packages or if there are any damages. If the customer does not have time at the time of delivery, he must add the words "subject to unpacking" on the delivery note, otherwise the seller will not be able to have recourse in the event of a problem. Without prejudice to any measures that may be adopted with respect to the transportation company, the customer must notify the seller by email [email protected] within 48 working hours, of any apparent defects or lack of conformity of the goods delivered. The customer must send the seller photos of the damaged packages in their packaging, then without the packaging; before the customer completes the assembly. After this period has elapsed, no claim of any kind will be admissible. If the customer expressly or implicitly waives the right to inspection before acceptance, it will be deemed that the goods have been delivered in accordance with the order. In the event of a defect or fault being identified after a subsequent re-inspection, the seller will only be under obligation to replace the goods acknowledged as faulty, at no expense to the seller, excluding any operating losses or additional damages. All products sold by UNNIQ HABITAT, S.L. are assembled and/or installed for use by the customer, who is exclusive liable for the assembly and/or installation.

Article 9. RIGHT OF RETURN AND CANCELLATION

The customer has a period of 14 days from receipt of the product in which they may exercise their right to return the goods without having to justify their reasons or pay any penalties, with the exception of transportation expenses for the returned goods. Any request for withdrawal or return must be made in the following way:

Contacting [email protected]. After verification, they will receive an email confirming their request including a return voucher, specifying the sender’s address, to print and attach to the package. The product must be returned in its original packaging, intact and complete (accessories and instructions), with no signs of usage, and ensuring that the return code indicated in the email approving the return clearly written on the package. The customer is responsible for organizing the return and providing proof of having done so, and that ensures proof of dispatch and receipt. The customer is liable for any expenses and risks involved in sending the returned goods. UNNIQ HABITAT, S.L. will provide a refund for the returned product within 30 days from receipt of the returned package. The customer is liable for all expenses incurred from returning the goods derived from the right of the cancellation. No refund will be given in the case of any incomplete, damaged or dirty items. In such cases, they will be returned to the customer at the customer’s expense.

In accordance with Article L 121-20-2 of the Consumer Code, the right to cancel stipulated for online sales cannot be exercised, unless the parties have agreed otherwise, in the case of contracts for the supply of goods manufactured to the consumer’s specifications or customized. The right of cancellation in the case of online shoppers does not apply to the sale of products that are customized at their request.

Article 10. GUARANTEE AND REFUND

1. UNNIQ HABITAT, S.L. accepts no liability for any damages caused by the misuse of the products sold.

2. Neither is UNNIQ HABITAT, S.L. liable for any change in the products that may be made by the manufacturers. The notifications and compositions published on the website are for information purpose only. UNNIQ HABITAT, S.L. may not be held liable for the information provided on the website, nor for any error, omission or modification that may be made therein. Any description or terminology used in any announcements on the website cannot be interpreted as a guarantee of the veracity of the description or terminology in question. UNNIQ HABITAT, S.L. does not guarantee the availability or correct functioning of its website or its components. Under no circumstances does UNNIQ HABITAT, S.L. guarantee that its website can be accessed without any errors, interruptions or defects, or that it is free from any disruptive external elements.

3. Any potential liability of UNNIQ HABITAT, S.L. is exclusively limited to the value of the product in question.

4. If applicable, the seller’s contractual guarantee is limited to the repair or replacement of the products that are faulty or that have defects in terms of the manufacturing, labelling or packaging. The seller is entitled to inspect alleged defects. All other explicit or implicit guarantees are excluded. No liability is accepted for direct or indirect damages or losses, regardless of the cause. The company UNNIQ undertakes to exchange defective parts, but in no case to pay for the installation of these parts.

5. In accordance with Article L 121-20-2 of the Consumer Code, the right to cancel stipulated for online sales cannot be exercised, unless the parties have agreed otherwise, in the case of contracts for the supply of good manufactured to the consumer’s specifications or clearly customized. The right of cancellation in the case of online shoppers does not apply to the sale of products that are customized at their request.
